On January 17, 2024, Simon Law attorneys Mary Simon and John Simon secured a $10,018,689.85 verdict on behalf of a client who suffered a severe ureteral injury during a routine c-section in 2016. The case was tried once previously and resulted in a hung jury in St. Louis County, Missouri.

Key Highlights

  • During a 2016 c-section following two hours of pushing, the attending doctor and a 4th-year resident encountered a deep extension on the left side of the uterine incision. They backfilled the bladder to check for injury, found none, and closed the abdomen.
  • The client returned six days post-op with high fevers and vomiting. It took 13 days for a urologist to identify that her left ureter had been completely obstructed by a stitch.
  • Over several months, the urologist stented and re-stented the ureter four times before determining a stent could not repair the damage.
  • Eight months post-op, the client underwent a left ureteral reimplantation, which permanently altered her bladder anatomy and removed the valve that keeps urine from refluxing into the kidney.
  • The client now experiences permanent urine reflux into her left kidney, voiding dysfunction, urine retention, and recurrent UTIs and kidney infections that have worsened. She must self-catheterize intermittently for the rest of her life. She was 18 at the time of the surgery.
