Missouri Supreme Court Declines to Review $10 Million Birth Injury Verdict Against Mercy Hospital

ST. LOUIS COUNTY, Mo. — The Missouri Supreme Court has declined to review a $10 million verdict obtained by Simon Law on behalf of a young mother who suffered a preventable surgical injury during childbirth at Mercy Hospital — making the judgment final in her favor.
Taylor Cayce was 18 years old when she went to Mercy Hospital for a routine cesarean delivery. Within days, she returned with severe pain and infection. A urologist eventually discovered that her left ureter had been stitched shut during surgery — an injury that could have been avoided, detected, and corrected before closure.
Attorney Mary Simon proved that this surgical mistake caused Ms. Cayce permanent medical complications. After hearing the evidence, a St. Louis County jury awarded $10,018,689.85 for her past and future losses.
The Defendants appealed, and in June 2025, Simon argued before the Missouri Court of Appeals for the Eastern District, which upheld the verdict. In September 2025, the Missouri Supreme Court denied Mercy’s request to transfer the case to the State’s highest court, finalizing the judgment in Ms. Cayce’s favor.
