Simon Law Wins Landmark $50 Million Wrongful Death Settlement in Case Against National Medical Equipment Provider in alleged failure to Provide Essential Respiratory Equipment
ST. LOUIS, MISSOURI – A man with special needs died after a national medical equipment provider allegedly failed to replace his medical device in a timely manner. Now, the deceased’s family will receive $50 million.
The deceased, a young man with intellectual disabilities also suffered from a serious respiratory condition, and required a respiratory device to help him breathe at night. After his respiratory device allegedly failed, his mother called the durable medical equipment supplier repeatedly for help. Days later, his mother found him unresponsive in his bed, dead from the respiratory condition.

A confidentiality agreement was part of the settlement, so Simon Law cannot name the major durable medical equipment supplier involved, but the St. Louis-based law firm accused the company of ignoring the mother’s pleas for help, violating federal Medicare standards by failing to provide a loaner machine, and choosing to seek reimbursement rather than aid a young man they knew needed help.
“Parents of children and adults with special needs spend their lives advocating for their children, sometimes serving as the voice they do not have,” Simon said. “This settlement serves as a voice for the young man who we allege needlessly died in this case and says ignoring a population that can’t speak for itself will not be tolerated.”
